Government Decision no. 1680/2008 state aid sheme

The Community Acquis in the field of state aids allows granting regional state aids to enterprises, under the Community Guidelines on regional state aid 2007-2013 (the Official Journal of the European Union no. C54/2006), and the European Commission Regulation no. 800/2008 declaring certain categories of aid compatible with the common market in application of
Articles 87 and 88 of the Treaty (European Union Official Journal no. L
214/2008).

The submitted documentation must show that the state aid has a ˝ incentive effect˝ and meets one or more of the following criteria:
CIBR signs anexclusive import contract with a Belgian technology provider for infra redheating panels that consume less then 30 % energy in comparison withconventional energy sources.
An Order has been published introducing new rules regarding the refund of value added tax ("VAT"). The main amendments brought by this Order are:
• The reimbursement decision will be issued within five days of submitting the VAT return in the following situations:
- The VAT refundable amount is equal to RON 10,000 or lower;
- The VAT returns are considered to be of low fiscal risk;
- The amount requested at reimbursement does not exceed the value of the Negative Individual Standard.

Amendments to the Labour Code were published on 31 March 2011.
According to the new law, the provisions of the job description will become paramount in assessing the professional performance of any employee, which will prevent abuses from employers. Also, the new Labour Code stipulates that professional performance will prevail in case of disposals made due to the economic situation of a company, thus replacing the old provisions that social criteria had to be taken into consideration first when undertaking disposals.
The most important changes include:
The minimum capital should be only 1 euro and capital must be raised only after five years.
The federal Cabinet has recently approved a draft Bill to introduce a new type of company. It is a private company with limited liability for starters, also called the Starter Bvba. The minimum capital is only 1 euro and is "tailored to young people who wish to start a business but lack the necessary capital, and for pensioners who wish to remain active and additional income for their retirement needs to add".

RE-ESTABLISHMENT OF THE LEGAL PROVISIONS REGARDING MICROENTERPRISES
Starting 2011, the microenterprise tax regime is reinforced. Thus, the entities which meet certain criteria (among which, it should have between 1-9 employees and should record a turnover less than EUR 100,000) may choose to pay a tax of 3% of the revenues instead of 16% corporate income tax. The entities which obtain revenues from banking, insurance and reinsurance, gambling, consultancy and management activities cannot apply this tax regime and will continue to be subject to 16% corporate income tax.
Romania has 9,7 million hectares and only 30% are used at this moment. Romania is currently supporting the restructuring of its agricultural industry towards a market economy. Only small changes in land use are expected. Self-sufficiency in cereals is expected to increase, consolidating their net export position. In the livestock sector,
Solar energy potential is given by the average solar energy quantity received in horizontal plane which is estimated at approximately 1,100 kWh/m2 per annum in Romania.
Romania's solar radiation map was drawn up considering the average, multi-annual data registered by the Romanian National Institute for Meteorology and Hydrology, processed and correlated with physical field observations and measurements conducted by specialized institutes. Considering the level of the registered solar energy flow, 5 geographical areas have been identified in Romania.
Biogas situation in a larger context
Two main aspects need special attention:
a) energy- renewable energies
b) environment - Kyoto protocol
In 2003 from the total gas need of the EU 49% was based on internal production and 51 % was coming from abroad (manly Russia).
In 2030 the net import of gas will reach as much as 80 % of the total need. This is in fact the basis for the development of the a common energy policy at European
level.
Romania has a wide range of renewable resources: hydro-energy, biomass, solar energy, wind energy and geothermal energy sources. However, they are currently virtually unexploited, except fro hydro-energy which is converted into power both in small and large hydropower plants.

Romania has joined the European Union. Since January 2007 the Romanian state improved the mobility of Romanian workers throughout Europe. Per year more then 4 million workers are performing works in foreign countries. The quality of being a member state within EU entitles the citizens of these states to benefit from the four fundamental liberties, for instance, free movement of citizens (persons) which implies also free movement of workers.
